The union argued and the arbitrator agreed that performance of certain listed duties or management responsibilities does not automatically lead to either inclusion or exclusion from the bargaining unit. To determine any potential conflict of interest with union's membership, a number of specified factors must be reviewed including similar positions in government and previous decisions of the Joint Exclusion Committee.
